Institutional theory of law (ITL) reflects both continuity and change of Kelsen's legal positivism. The main alteration results from the way ITL extends Hart's linguistic turn towards ordinary language philosophy (OLP). Hart holds –like Kelsen – that law cannot be reduced to brute fact nor morality, but because of its attempt to reconstruct social practices his theory is more inclusive. By introducing the notion of law as an extra-linguistic institution ITL takes a next step in legal positivism and accounts for (...) the relationship between action and validity within the legal system. There are, however, some problems yet unresolved by ITL. One of them is its theory of meaning. An other is the way it accounts for change and development. Answers may be based on the pragmatic philosophy of Charles Sanders Peirce, who emphasises the intrinsic relation between the meaning of speech acts and the process of habit formation. (shrink)

We have compared two different laser-induced optical light traps for their utility in moving organelles within living animal cells and walled fungal cells. The first trap employed a continuous wave neodymium-yttrium aluminum garnet laser at a wavelength of 1.06 micron. A second trap was constructed using a titanium-sapphire laser tunable from 700 to 1000 nm. With the latter trap we were able to achieve much stronger traps with less laser power and without damage to either mitochondria or spindles. Chromosomes and (...) nuclei were easily displaced, nucleoli were separated and moved far away from interphase nuclei, and Woronin bodies were removed from septa. In comparison, these manipulations were not possible with the Nd-YAG laser-induced trap. The optical force trap induced by the tunable titanium-sapphire laser should find wide application in experimental cell biology because the wavelength can be selected for maximization of force production and minimization of energy absorption which leads to unwanted cell damage. This is the first full-length biography of John Langshaw Austin (1911–60). The opening four chapters outline his origins, childhood, schooling, and time as an undergraduate, while the next four examine his early career in professional philosophy, looking at the influence of Oxford Realism, Logical Positivism, Pragmatism, and the later Wittgenstein. The central twelve chapters then explore Austin’s wartime career in British Intelligence. The first three examine the contributions he made to the campaigns in North Africa; the next seven the seminal (...) role he played in ensuring the outstanding accuracy of the D-Day Intelligence; while the final two explore his contributions to Arnhem, the Ardennes, and the post-war administration of Germany. The last main section of the book then outlines and assesses Austin’s contributions to post-war Oxford Ordinary Language Philosophy. The first three chapters discuss the impact on Oxford philosophy of the cultural atmosphere of post-war Britain and the later Wittgenstein’s ideas. The next four look at Austin’s influence on post-war Oxford, particularly his Saturday morning discussion group and his perception lectures. The next five chapters concentrate on America’s influence on Austin and vice versa, paying particular attention to Austin’s work on speech-acts and his semesters in Harvard and Berkeley. The final two chapters examine Austin’s declining influence in Oxford, and his tragically premature death. (shrink)
